RESOLVED that the minutes of the Regular Meeting of the Town Board, held on September 2, 1981, as presented by the Town Clerk, be and are hereby approved, and be it further

RESOLVED that the reading of these minutes be and is hereby dispensed with as each member of the Town Board had previously received copies thereof.

Old Business #1 - Schedule Public Hearin• Re: Rubbish and Trash Collection Facility.

):THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN PENNY, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN MILL, TO WIT:

WHEREAS, this Board has been requested to pass an amendment to the Code-of Ordinances of the Town of Orchard Park establishing a rubbish and trash collection facility and to set fees for the use thereof

NOW, THEREFORE, be it

RESOLVED that the Town Board be and is hereby authorized to schedule a Public Hearing on October 7, 1981 at 8:30 P.M. EDT at the Municipal Building, 4295 S. Buffalo St., Orchard Park, New York, pursuant to Section 130 of the Town Law of the State of New York, in the matter of a proposed amendment to the Town Code of Ordinances in the Town of Orchard Park to authorize the Highway Commissioner to establish and operate a rubbish and trash Collec­tion facility, together with a recycling center at a proposed site on Taylor Road across from the Town Garage,

and further

to authorize the Highway Commissioner to charge the following fees to users of the said rubbish and trash collection facility:

1)       $15.00 per pickup truck, van or small trailer

2)       $1.50 per private automobile

No larger vehicles to have access to the facility

and be it further

RESOLVED that the Town Clerk be and is hereby directed to publish due notice thereof in the Suburban Press, a newspaper circulating in said Town of Orchard Park, in accordance , with the requirements of Town Law.

Town Attorney Raymond McNamara directed the Board to enter into an agreement with Wickes Lumber Company before the facility is put into operation if the amendment is adopted after the Public Hearing.

Old Business #2 - Tri-Delta Aggregates, Big Tree Rd. - Special Exception Use for Storage Equip.

RESOLVED that the Town Board be and is hereby authorized to schedule a Public Hearing on October 7, 1981 at 8;45 P.M. EDT in the matter of a Special Exception Use for portion of land for Equipment Storage in an I-1 zone as petitioned by Tri-Delta Aggregates,. Inc, Big Tree Road, Orchard Park, New York,

Old Business #4 - Agreement for Senior Citizens with Orchard Park Schools.

3)         THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN MILL, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN DIGGINS, TO WIT

RESOLVED that the Town Board be and is hereby authorized to direct the Supervisor to sign the Agreement with the Orchard Park Central School District for the use of the District's "Lincoln Building" by Senior Citizens in an amount not to exceed Three hundred ($300,00) Dollars for the year 9/81- 6/30/82.

 

THE RESOLUTION WAS UNANIMOUSLY ADOPTED.

 

The Supervisor requested a meeting be held with the Orchard Park Central School to draw up agreements between the Town of Orchard Park and the School District re: 1) use of business for Senior Citizens recreation and 2) area ball diamonds. All Town involved personnel shall be notified of the meeting.

PUBLIC HEARING

At 8;15 P.M. EDT, the advertised time, the Supervisor called for the Public Hearing to all interested parties or citizens for or against the adoption of an amendment to the Zoning Ordinance of the Town of Orchard Park which provides as follows:

ARTICLE 4.5 "Adult Uses"

SECTION 13--39,  DEFINITIONS

As used in this article, the following terms shall have

the meanings indicated;

a.   ADULT BOOKSTORE - an establishment having as a substantial or significant portion of its stock and trade books, magazines, films for sale or viewing on premises, by use of motion picture devices


or any other coin-operated means and other periodicals which are distinguished or characterized by their emphasis on matter depicting, describing, or relating to specified sexual activities or specified anatomical areas or an establishment with a segment or section devoted to the sale or display of such material.

b. ADULT ENTERTAINMENT CABARET - public or private establishment which is licensed to serve food and/or alcoholic beverages, which features topless dancers, strippers, male or female impersonators or similar entertainers.

c. ADULT MINI-MOTION PICTURE THEATRE - an enclosed building with a capacity of less than fifty (50) persons used for presenting material distinguished or characterized by an emphasis on matter depicting, describing, or relating to specified sexual activities or specified anatomical areas for observation by patrons therein.

d. ADULT MOTION-PICTURE THEATRE - an enclosed building with a capacity of fifty (50) or more persons used regularly and routinely for presenting material having as a dominant theme material distinguished or charac­terized by an emphasis on matter depicting, describing, or relating to specified sexual activities or specified anatomical areas for observation by patrons therein.

e. PERSON - any person, firm, partnership, corporation, association, or legal representative, acting individually or jointly.

f. SPECIFIED ANATOMICAL AREAS - less than completely and opaquely covered human genitals, pubic region or female breast below a point itmedi,ately above the top of ' the areola.  Humane male genitals in a disceifnib1y turgid sta-t c;Ir even if completely and opaquely covered.

g. SPECIFIED SEXUAL ACTIVITIES--human genitals in a state of sexual stimulation or arousal

Acts of human masturbation, sexual intercourse or sodomy

Fondling or other erotic touching of human genitals, pubic region, buttock or, female breast.

SECTION-13-40, RESTRICTIONS AFFECTING ADULT USES

 Adult uses, including but not limited to adult bookstore, adult motion-picture theatre, adult mini-motion picture theatre, and adult entertainment cabaret shall be permitted subject to the following restrictions:

a.    No such adult use shall be allowed within one thousand five bun- (1500) -feet of another existing adult uses

b.    No such adult use shall be located within one thousand five hundred (1500) feet of the boundaries of any zoning district which is zoned exclusively for residential use (those zones designated R-1, 2, 3, or 4).

c.   No such adult use shall be located within one thousand five hundred five hundred (1500) feet of an existing school or place of worship.


d. Adult uses shall be classified as a special exception use in the I-1 district and shall not commence operation until securing a permit pursuant to Article 7 of this ordinance entitled special uses.

SECTION 13-411. REGISTRATION.

 A. The owner of a building or premises, his agent for the purpose of managing or controlling or collecting rents or any other person managing or controlling a building or premises, any part  which contains an adult use, shall register the following informal with the Town Clerk of the Town of Orchard Park;

1.                   The address of the premises;

2.                   The name, and address of the owner of the premises and the names and addresses of he beneficial owners if the property is in a land trust;

3.                   The name of the business or the establishment subject to the provisions of this Article;

4.                   The name(s) and address(es) of the owner, beneficial owner or the major stockholder(s) of the business or the establishment subject to the provisions of this Article;

5.                    The date of initiation .of the adult use;

6.                    The nature of the adult use;

7.                    If the premises or building is leased, a copy of said lease 

B. It is a violation of this Article for owner or person in control of any property to establish. or operate thereon or to permit any person to establish or operate thereon an adult use without having properly registered said adult use with the Town Clerk.

SECTION 13--42, DISPLAY OF COPY OF REGISTRATION

The owner manager or agent of a registered adult use shall display in a conspicious place on the premises of the adult use a copy of the registration filed with Town Clerk.

SECTION 13-43, PROHIBITION REGARDING PUBLIC OBSERVATION

No adult use shall be conducted in any manner that permits the observation of any material depicting, describing or relating to specified sexual activities or specified. anatomical areas from any public way or from any property not registered as an adult use. This provision shall apply to any display, decoration, sign, show window, or other opening.

 

Affidavits of Publication and Posting of the Legal Notice of the Public Hearing were presented, read aloud and filed with the Town Board by the Town Clerk. The affidavit is entered into and attached to these minutes

WHEREAS, following due and timely notice, a Public Hearing relating to the matter of an amendment to the Zoning Ordinance of the Town of Orchard. Park entitled "Adult Uses" was conducted at the Municipal Building, 54295 South Buffalo Street, Orchard. Park, New York on the 16th day of September, 1981 at which all interested parties were given an opportunity to be heard, and

WHEREAS, approval from the Town of Orchard Park Planning Board was received and filed with the Town Board

NOW, THEREFORE, be it

RESOLVED AND ORDAINED, that the Zoning Ordinance of the Town of Orchard Park be and is hereby amended as follows:

ARTICLE 4.5 "Adult Uses"

SECTION 13-39i DEFINITIONS

Human male genitals in a discernibly turgid stater even if completely and opaquely covered..

g.                SPECIFIED SEXUAL ACTIVITIES - human genitals in a state of sexual stimulation or arousal

 

Acts of human masturbation, sexual intercourse or sodomy.

Fondling or other erotic touching of human- genitals, pubic region, buttock or female breast.

SECTION 13-42, DISPLAY OF COPY OF REGISTRATION

The owner, manager or agent of a registered adult use shall display in a conspicuous place on the premises of the adult use a copy of the registration filed with Town Clerk;

Before the vote was taken, a discussion was held by the Town Board Members and the Town Attorney re: the amendment specifics and the impact it will have on the Town of Orchard Park and all the residents of Orchard Park by allowing "Adult Uses" as a Special Excep­tion Use in an I-1 Zone,

 

Councilman Diggins withdrew his second of the motion and a decision shall be made at the October 7th, 1981 Town Board Meeting,

Councilman Penny, reported on minutes of 9/8/81 and letter from the Orchard Park Con­servation Board dated 7/18/79 re: proposed site work plan on Downer (now Swyer) prop­erty, 3385 Orchard Park Roth, The Conservation Board feels there is considerable fill to be placed within the ten (10) year flood line.

 

The Town Engineer stated he has re­viewed the area and the latest plans submitted comply with all restrictions.

 

Councilman Mill reported on a meeting held with Global TV and will have meetings on a regular basis during the installation of Cable in Orchard Park to keep the residents informed of the progress of the installation. Global TV is taking all information calls from Orchard Park residents and have assigned one person to monitor these calls.

RESOLVED that the Town Board be and is hereby authorized to send a letter to the Village Board of Orchard Park requesting the Village Board to act quickly on the request from Global Cable TV, Inc, to use the Village Watare Tower to locate a "dish" to receive sig­nals in Orchard Park,

Councilman Curley reported 1) the Public Improvement Proposal and Article 4.5 "Adult Uses" amendments to the Zoning Ordinances, the Public Hearings that were held and the need for more study by the Town Board before a decision shall be made and 2) requested the Town Insurance Committee prepare a written memorandum re: the feasibility of the required insurance requirements for the Public Improvements Proposal to be available for a meeting to be scheduled shortly with the opponents to the amendment and all in­volved Town Personnel.

RESOLVED that the Town Board be and is hereby authorized to schedule a bid opening on October 20, 1981 at 10:15 A.M. EDT in the Supervisor's Office for the Baker Road Sani­tary Sewer extension as recommended by the Town Engineer, and be it further

RESOLVED that the Town Clerk be and is hereby directed to publish due notice thereof.

THE RESOLUTION WAS UNANIMOUSLY ADOPTED.

 

At this time the Supervisor reminded the Town Board that a part of the Town Highway heating system needs replacing. This will be a General Fund item and Don Kam submitted an estimate of $4,845.00,

 

There being no further business before the Town Board, the Supervisor adjourned the meeting at 9:22 P.M. EDT.
