APPROVING MINUTES: THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN CURLEY, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN MILL, TO WIT:
RESOLVED that the minutes of the Regular Meeting of the Town Board held on May 2, 1984, as presented by the Town Clerk, be and are hereby approved, and be it further
RESOLVED that the reading of these minutes be and is hereby dispensed with as each member of the Town Board had previously received copies thereof.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
At this time, Supervisor Woodard recognized Richard and Beth Coster, 32 Middlesex Road in the audience. They requested the Town Board's help in having the property at 30 Middlesex Road cleaned up. The junk and condition of this property is absolutely deplorable and they are concerned about the possible devaluation of their property because of this. They have been in contact with the Building Inspector and feel he has done as much as he can to get some action on this problem. Building Inspector Sweet stated he had given the owners of 30 Middlesex Road until May 15,11984 to clean up their property. A discussion was held by the Town Board and the Town Attorney. The Building Inspector was instructed to start court proceedings with the advice of counsel.

RESOLVED that the Town Board be and is hereby authorized to approve the Entrance and Exit signs as filed by S.M. Flickinger Co., Inc. (Super Duper) 3930 N. Buffalo Street and as recommended by the Safety Committee.

RESOLVED that Town Board does declare a Negative Declaration under the SEQR Law and Regulations as recommended by the Planning Board.

New Business #1 - N.Y. Community Action Network (NYCAN) door to door canvass in O.P.
4) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN DIGGINS, WHO MOVED ITS ADOPTION, SECONDED BY SUPERVISOR WOODARD, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to approve the request from New York Community Action Network (NYCAN) 2633 Main St., Buffalo; N.Y. to conduct a charitable door to door canvass in the Town of Orchard Park beginning in June and extending thru the summer of 1984 between the hours of 4 PM and dusk.

PUBLIC HEARING
At 8:15 P.M. EDT, the advertised time, the Supervisor called for the Public Hearing to hear all interested parties and citizens for or against the adoption of an amendment to the Code of Ordinances of the Town of Orchard Park - Article II - Dangerous and Unsafe Buildings which amendment provides as follows:
it is recommended that Article II of the Orchard Park Town Code, entitled Dangerous and Unsafe Buildings, be amended to comply with recent changes in Section 130 of the Town Law. The changes that should be made are as follows:
a. Repeal Section 5-19, entitled Survey and Report at Direction of the Town Board;
b. Repeal Section 5-20, entitled Report of Survey to be Posted;
c. Repeal Section 5-21, entitled Application for Court Order to Abate Condition;
d. Repeal Section 5-22, entitled Compensation of Surveyors.
Adopt new Section 5-19. FILING OF NOTICE OF PENDENCY
The Town Board shall provide for the filing of a copy of a notice in the Office of the Erie County Clerk, which notice shall be filed by such Clerk in the, same manner as a notice of pendency pursuant to Article 65 of the Civil Practice Law and Rules, and shall have the same effect as a notice of pendency as therein provided, except as otherwise hereinafter provided in this paragraph. A notice so filed shall be effective for a period of one (1) year from the date of filing, provided, however, that it ay be vacated upon the order of a judge or justice of a court of record or upon the consent of the town attorney. The Erie County Clerk shall mark such notice and any record or docket thereof as canceled of record upon the presentation and filing of such consent or of a certified copy of such order.
Adopt new Section 5-20 HEARING
There shall be a hearing before the town board, notice of which and the time and place thereof to be specified in the notice to repair or demolish.
Adopt new Section 5-21. SERVICE OF NOTICE
Notice of the hearing referred to in Section 5 - 20 shall be served upon the owners and such persons having an interest in the property or structure as is described in the notice.
Adopt new Section 5-22. REMOVAL OF STRUCTURE
The town board shall provide for the, removal of such building or structure by the town in the event such owner fails or refuses to repair or remove the same within the time provided.
Affidavits of Publication and Posting of the Legal Notice of the Public Hearing were presented,' read aloud and filed with the Town Board by the Town Clerk. The affidavit is entered into and attached to these minutes.

Buffalo Street, Orchard Park, New York on the 16th day of May, 1984 at which all interested parties were given an opportunity to be heard, and
WHEREAS, no objection" from the Erie County Department of Planning, pursuant to Section 239-m of the General Municipal Law was received and filed by the Town Board,

RESOLVED AND ORDAINED, that the Code of Ordinances.- Article II - Dangerous and Unsafe Buildings, of the Town of Orchard Park be and is hereby amend as follows:

7) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN DIGGINS, WHO MOVED ITS ADOPTION,
SECONDED BY COUNCILMAN MILL, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to refer to the Planning Board and Conservaton Board the request from Buffalo Circuits, Inc., 105 Mid County Drive for a building permit to build a 2,000 ft. addition to existing building.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
At this time Supervisor Woodard recognized Ed Jensen from the floor. Mr. Jensen explained he was representing the Orchard Park Volunteer Fire Co. Softball League, Bar-room Brawlers League (Patrick's Pub & Big Tree Inn),' Orchard Park Fireman's Church Softball League and District 5T Ball. There is a definite need for at least one, if not more ball diamonds in Orchard Park. Over 800 citizens (voters) use the diamond on the Old Lincoln School property and, through the generosity of Mr. Tim Gow this ball diamond has been made available to the Fire Company for use in return for their upkeep and maintenance of the diamond area. The school diamonds were not available until May 7th because of the inclement weather. The Town Board stated they will try to solve this problem for next year with the help of the Recreation Director.

Councilman Diggins stated he was pleased to see the "No Parking" signs have been placed on both sides of the driveway entrance to the Municipal Building. Hopefully,. striping shall soon be done to designate the area and strict enforcement of these two areas shall be made.
Councilman Curley requested the Town Board to take action on the letter received from Tim Gow offering the Town the opportunity to take an option on the Old Lincoln School Building property. Supervisor Woodard tabled the request for research and review by the Town Board.

PUBLIC HEARING
At 8:30 P.M. EDT the advertised time, the Supervisor called for the Public Hearing to hear all interested parties and citizens for or against the adoption of an amendment to the Zoning Ordinance of the Town of Orchard Park governing. Antennas and Windmills which amendment provides as follows:
SECTION 13-52 HEIGHT REGULATIONS
(A) Permitted exceptions to height regulations. The height limitations of Article IV and Article V shall not apply to antennae of a licensed amateur radio operator who operates for a non-commercial purpose under a license issued pursuant to Part 97 of the Federal Communications Commission's Regulations 'whose antenna does not exceed sixty feet in total height above ground level and does not occupy more than one-tenth 1 10th of the roof area,, chimneys, church spires and belfries, silos, tanks, ventilators or necessary mechanical features not occupying more than one-tenth (110) of the roof area.
(B) Roof mounted antennae, including dish antennae, or other devices for receiving, sending, or relaying electronic signals shall not project more than six (6) feet above the highest point of the building or exceed ten (10) square feet of wind resistance area.
Section 13-55 ACCESSORY STRUCTURES
(A) Minimum Regulations.
(1) Unattached accessory structures in R districts. Accessory structures, which are not attached to a principal structure, may be erected in accordance with the following requirements:
(a) An accessory building shall not exceed one (1) story or eighteen (18) feet in height and may occupy not more than twenty-five (25) percent of a required rear yard.
(b) No accessory structure shall be located within the front yard or required side yard.
(c) No accessory structure shall be located closer than ten (10) feet to any dwelling.
(d) No accessory structure shall be located closer than ten (10) feet to the rear lot line.
(2) Attached accessory structures in R districts and A districts. When an accessory structure is attached to the principal building it shall comply in all respects with the yard requirements of this chapter applicable to the principal building.
(3) Accessory structures in other than R districts. The provisions of this subdivision relating to accessory structures shall not apply to farms as defined in this chapter. (Res. of 12-1-76, SS 3-5)
(4) Accessory structures, antennae, including dish antenna, or other devices for receiving, sending or relaying electronic devices, all districts.
The structure shall have a permanent foundation. The extremities of
the device including guy wires or anchors shall comply in all
respects with the yard requirements of this chapter applicable to unattached accessory structures and shall not exceed twelve (12) feet in height.
a. Corner lots: The structure shall not be located between the side street lot line and the principal building.
(5) Accessory structures, windmills, windvanes or
similar energy converting devices. Permitted in A-I and I-1 districts only.
The total design of any structure and its components shall be reviewed and stamped by Professional Engineer (s).
a. The set back from any side, rear lot line or any.
building or accessory building shall be equal to the overall height of the structure plus ten (10) feet.
b. Corner lots: The structure shall not be located between the side street lot line and the principal building.
c. The height shall not exceed forty (40) feet.

RESOLVED that the Public Hearing in the matter of an amendment to the Zoning Ordinance governing Antennas and Windmills be and is hereby closed at 8:59 P.M. EDT.
PUBLIC HEARING
At 9:00 P.M. EDT, the advertised time, the Supervisor called for the Public Hearing to hear all interested parties and citizens' input regarding the use of Federal Community Development Funds in the Town of Orchard Park for the year 1984.
Affidavits of Publication and Posting of the Legal Notice of the Public Hearing were presented, read aloud and filed with the Town Board by the Town Clerk. The affidavit is' entered into and attached to these minutes.
THE FOLLOWING SPOKE:
1. Peter D. Pook - Quaker Arts Pavilion Campaign Co-Chairman Requested the use of $10,000.00
2. Edward Jensen - Representing Softball Leagues in the Town - Requested up to $5,000.00 be used to provide a couple more baseball diamonds
13) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN DIGGINS, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN CURLEY, TO WIT:
RESOLVED that the Public Hearing in the matter of the use of Federal Community Development Funds for the year 1984 be and is hereby closed at 9:11 P.M. EDT.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
Councilman Mills reported the Zoning Commission at it's meeting on May 14, 1984 went on record supporting the resolution adopted by the Town Board on February 2, 1983 allowing the Town under State Law to prohibit Mobile Home Parks in the Town of Orchard Park.
Building Inspector Robert Sweet stated 73 Building Permits were issued in the month of May. He requested the help of the newspapers to make residents aware of the need to obtain Building Permits before any building is started including such buildings as tool sheds etc.
14) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN CURLEY, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN DIGGINS, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to direct the Town Board to send a letter to the County Commissioner of Public Works, Philip F. Frandina, to place upon the County Agenda as top priority for 1985 the continuation of the reconstruction of Jewett Holmwood Road from the completion of Phase I to the Town of Orchard Park line, and be it further
RESOLVED the Town shall be involved in the relocation of water lines at a cost to Water District #15.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
15) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN MILL, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN CURLEY, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to approve the request from Highway Superintendent Geitter to attend the Cornell School for Highway Superintendents June 4-6, 1984 at town expense as provided in the budget.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
16) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN CURLEY, WHO MOVED ITS ADOPTION, SECONDED BY SUPERVISOR WOODARD, TO WIT:
WHEREAS, the Town Highway has scheduled road work, drainage work and the removal of a blind curve on Bunting Road between Draudt Road and Newton Road
NOW, THEREFORE, be it
RESOLVED that the Town Board be and is hereby authorized to direct the Town Attorney to obtain the necessary Right of Way needed to start and complete this work.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
17) THE FOLLOWING RESOLUTION WAS OFFERED BY SUPERVISOR WOODARD, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN DIGGINS, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to receive and file the Map, Plan and Report for the proposed improvements to Orchard Park Sanitary Sewer #12 as prepared by the Town Engineer.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
18) THE FOLLOWING RESOLUTION WAS OFFERED BY SUPERVISOR WOODARD, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN DIGGINS, TO WIT:
RESOLVED that the Town Board be and is hereby authorized to adopt the Order scheduling a Public Hearing on June 6, 1984 at 8:15 P.M. EDT in the matter of the proposed improvements to Orchard Park Sanitary Sewer #12, and be it further
RESOLVED the Town Clerk be and is hereby directed to publish due notice thereof.
THE RESOLUTION WAS UNANIMOUSLY ADOPTED.
