A Meeting of the Town Board of the Town of Orchard Park, Erie County, New York, was held at the Orchard Park Municipal Center, S4295 South Buffalo Street, Orchard Park, New York on the 5th day of January 2000 at 8:00 P.M., (local time). The meeting was called to order by the Supervisor and there were

1) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN BUYER, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN McCARVILLE, TO WIT:

 

RESOLVED, that the minutes of the regular meeting of the Town Board, held on December 1, 1999, and Special Meeting held on December 8, 1999, as presented by the Town Clerk, are hereby approved, and be it further,

 

RESOLVED, that the reading of these minutes be dispensed with as each member of the Town Board has previously received copies thereof.

                                          The resolution was unanimously adopted.

 

 

Old Business #1 – Jerome Orffeo,  5511 S. Abbott Rd, Out-of-District Water Customer request

 

2) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN BUYER, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN McCARVILLE, TO WIT:

 

RESOLVED, that the Town Board of the Town of Orchard Park, Erie County, New York, hereby consents and approves the public water service be furnished to the following property owner, at the address set opposite his name, as follows:

by the 1993 Master Water Improvement Area (SW-36) of the Town of Hamburg as an out-of-district customer, and that the Town Board further consents and approves that in the event of a default in payment with respect to said water service, said sum or sums as may be unpaid my be placed on the tax rolls of the Town of Orchard Park for collection thereof; and be it further

RESOLVED, that when and if the Town of Orchard Park forms a Water District to service the area in which this petitioner resides, this petitioner be and is hereby obligated to join the Town of Orchard Park Water District; and be it further,

 

RESOLVED, that the Town of Hamburg Water District involved is under Lease Management with the Erie County Water Authority and that the permission granted above be and is hereby subject to the approval of the Erie County Water Authority’s Engineering and Tariff Requirements; and be it further

 

RESOLVED, that this approval is contingent upon the applicant signing an agreement acceptable to the Town Attorney.

 

 The resolution was unanimously adopted.

 

 

Old Business #2 Award Police Car Bids

 

3) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILWOMAN ACKERMAN, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN McCARVILLE, TO WIT:

 

WHEREAS, bids for two (2) new police vehicles and one (1) unmarked police car were received and opened on December 30, 1999,

 

NOW, THEREFORE, be it

 

RESOLVED, that the Town Board is hereby authorized to award the bid for two new police cars and one unmarked police car to DeLacy Ford, 3061 Transit Road, Elma, NY 14059, being the lowest responsible bidder in the amount of $38,634.00 with trades included, as recommended by the Chief of Police.

 

 

The resolution was unanimously adopted.

 

 

 

New Business #1 Authorize Supervisor to sign Erie Co. Senior Services Van Contract for 2000

 

4) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN MILLS, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN BUYER, TO WIT:

 

RESOLVED that the Town Board does hereby authorize the Supervisor to sign the agreement with the Erie County Department of Senior Services for the 2000 Town of Orchard Park Van Services.

 

 

The resolution was unanimously adopted.

 

 

 

 

 

 

ELECTED OFFICIALS & DEPARTMENT HEADS

 

Supervisor Cudney announced that the Millennium Commemoration Committee will next meet on January 11, 2000 at 7:00 PM in the Supervisor’s Conference Room and that anyone who is interested is welcome to attend.  Supervisor Cudney thanked Howie Holmes for the New Year Eve Ball drop and fire works.  She also thanked Nan Ackerman for having the reception following the Ball drop in the Post Office, Mr. Rebman, Chris Coleman and all who helped make New Year’s Eve a wonderful celebration.

 

Councilman Mills congratulated everyone involved who made New Year’s Eve an outstanding event, and he said that these people are the unsung heroes who make Orchard Park such a great place to live.  Councilman Mills said that Business First rated the Village of Orchard Park as the #1 village in Erie and Niagara counties for quality of life, and the Town of Orchard Park was rated #2, which is well deserved as evidenced by the New Years Eve celebration.  Councilman Mills wished everyone a Happy New Year.

 

Councilwoman Ackerman said that it’s all about building happy memories and doing things together that makes people pitch in and do the extra things that are so special.  She also wanted to thank all the people who supported her in the last election, as she feels honored to serve the community and will do all she can to keep Orchard Park a special place.

 

Councilman McCarville thanked everyone for making New Year’s Eve so special.

 

Town Clerk Colarusso thanked everyone for their support this year, as she loves working for the Town of Orchard Park.

 

Building Inspector Campion said that August Munk, of Big Tree road will be served a summons to appear in court to explain why he has not cleaned up his property, as they have been trying to get him to do for some time.

 

Police Chief McCune reported that in regards to the parking situation on East Quaker St., the NYS DOT erected four (4) no parking signs on the north side of East Quaker St., east and west of Baker Road.  They did not go along with our recommendation as they feel this measure will handle the parking problem.  Chief McCune said that he will keep in contact with the NYS DOT to monitor this situation.

 

5) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN McCARVILLE, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILWOMAN ACKERMAN, TO WIT:

 

RESOLVED, that the Town Board hereby authorizes the approval of all entries on Warrant #1, following auditing by members of the Town Board and in the funds indicated:

RESOLVED, that the Town Board is hereby authorized to receive and file the following communication:

Letter from Senator Daniel Patrick Moynihan to Supervisor Cudney regarding the Federal Land & Water Conservation Fund.

 

The resolution was unanimously adopted.

 

 

 

7) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILWOMAN ACKERMAN, SECONDED BY COUNCILMAN MILLS, TO WIT:

 

RESOLVED, that the Town Board is hereby authorized to receive and file the following report as entered on the agenda: 1) The Chief of Police Monthly Report for December, 1999.
