A Meeting of the Town Board of the Town of Orchard Park, Erie County, New York, was held at the Orchard Park Municipal Center, S4295 South Buffalo Street, Orchard Park, New York on the 21st day of February 2007 at 7:00 P.M., (local time). The meeting was called to order by the Supervisor and there were:

1) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILWOMAN ACKERMAN, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN KACZOR, TO WIT:

 

RESOLVED, that the minutes of the Meeting of the Town Board held on February 7, 2007 and the Executive Session Minutes for February 7, 2007, as presented by the Town Clerk, are hereby approved, and be it further

 

RESOLVED, that the reading of these minutes be dispensed with as each member of the Town Board has previously received copies thereof.

The resolution was unanimously adopted.

 

 

New Business #1 Schedule Public Hearing for Premium Coffee Relocating into an Empire Zone

 

2) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN KACZOR, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILWOMAN ACKERMAN, TO WIT:

 

RESOLVED, that the Town Board does hereby schedule a Public Hearing, Wednesday, March 21, 2007 at 7:00 PM, for the re-location of Premium Coffee, Inc., from the Town of Orchard Park to the City of Lackawanna Empire Zone, and be it further

 

RESOLVED, that the Town Board does hereby direct the Town Clerk to publish due notice thereof.

 

Councilman Kaczor explained that in order for a company to receive all the benefits of an “Empire Zone”, they need the consent to move from the municipality that they are currently in.

 

The resolution was unanimously adopted.

New Business #2 Compost Site to hold Bid Opening for a “Yard Waste Recycler” March 12, 2007

 

3) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILWOMAN ACKERMAN, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMAN KACZOR, TO WIT:

 

RESOLVED, that the Town Board does hereby authorize the Highway Superintendent to hold a bid opening, Monday, March 12, 2007, at 11:00 AM for a “Yard Waste Recycler”. All bids will be opened in the Town Board’s Conference room located in the Municipal Center, and be it further

 

RESOLVED, that the Town Board does hereby direct the Town Clerk to publish due notice.

 

The resolution was unanimously adopted.

 

 

New Business #3 Orchard Park Garden Club to hold their Annual Plant Sale May 18 & 19, 2007

 

4) THE FOLLOWING RESOLUTION WAS OFFERED BY SUPERVISOR TRAVERS MURPHY, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILWOMAN ACKERMAN, TO WIT:

 

RESOLVED, that the Town Board does hereby approve the request of the Orchard Park Garden Club to erect a tent on town owned property next to the Railroad Depot for their 2007 Plant Sale, May 18 & 19, 2007, and be it further

 

RESOLVED, that the Orchard Park Lions Club will obtain the Certificate of Liability Insurance with the Town of Orchard Park being named as additional insured.

 

The resolution was unanimously adopted.

5) THE FOLLOWING RESOLUTION WAS OFFERED BY SUPERVISOR TRAVERS MURPHY, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILWOMAN ACKERMAN, TO WIT:

 

WHEREAS, the Town is in the process of closing its accounting records for the fiscal year ended December 31, 2006, and

 

WHEREAS, certain appropriation accounts were noted to need adjustments to allow for appropriate closing of accounts, and

 

WHEREAS, the funding for these adjusted appropriations is available within other appropriation accounts in the Town’s 2006 budget,

 

NOW, THEREFORE, be it
