Minutes of the January 4, 2005 meeting of the CONSERVATION BOARD of the TOWN OF ORCHARD PARK, Municipal Center, Second Floor Conference Room, 4295 South Buffalo Street, Orchard Park, New York at 7:00 PM, present were the following:

The Chairman called the meeting to order at 7 p.m. by stating that any person before this Board who is a relative of, or who has a financial or business relationship with, any officer or employee of the Town of Orchard park must disclose the nature and extent of such relationship in accordance with the provisions of the Ethics Law of the Town of Orchard Park.

 

Mr. Schechter excused himself from Other Business item #1 because of a business relationship with the petitioner.

 

Mr. Newton excused himself from Other Business item #8 due to a relationship with the petitioner.

 

APPROVAL OF MINUTES:

 

A motion was made by Mr. Schechter, seconded by Mr. Newton, to accept the minutes of the November 2, 2004 meeting.

 

THE MOTION WAS UNANIMOUSLY APPROVED.

 

1.            C.B. Sub. File #26-04, proposed “Traditional Neighborhood”, 62.2 acres of vacant land, west side of Bussendorfer Road, north of Armor Duells Corners Road, Zoned R-2.  Requesting Conservation Board approval of proposed deeded recreation land.  Tabled by the Conservation Board on 11/2/04.

 

This item was removed from the agenda at the request of the petitioner.

OTHER BUSINESS:

 

1.            Conservation Board review of revised landscape plan for Quaker Plaza (Orchard Park and Michael Roads).

Mr. Manguso explained to the Board that Quaker Plaza was requesting permission to remove two trees along Orchard Park Road in order to make the existing sign on the property more visible.  In addition, they were proposing to add 61 various planted shrub arrangements along Orchard Park Road and in the vicinity of the sign.

 

After discussion, it was agreed that the petitioner would replace the two trees to be taken down with two Spring Snow crabapples to be planted in the vicinity of the existing flagpole. 

 

Chairman Loesch directed Mr. Brzezinski to inform the Planning Coordinator of the estimated cost of the additional trees and shrubs to be planted and that a landscape completion bond will be required based on that amount.

 

Mr. Jaeger made a motion, seconded by Mr. Ward, to accept the plans as presented with the modifications discussed above.

 

THE MOTION WAS UNANIMOUSLY APPROVED.

 

2.            Conservation Easement request – Robert Santucci, 5886 Seufert Road.  Requesting a 50-year easement on 33.4 acres.

 

Mrs. Bergantz and Mr. Schichtel reviewed the property.  Mrs. Bergantz recommended that the Conservation Board accept the easement.

 

Mr. Schechter made a motion, seconded by Mr. Jaeger, to accept the conservation easement.

 

THE MOTION WAS UNANIMOUSLY APPROVED.

 

3.            Conservation Easement request – George & Marie Preshoff, 5721 Seufert Road.  Requesting a perpetual conservation easement on 6 acres. 

 

Mrs. Bergantz and Mr. Schichtel reviewed the property.  Mrs. Bergantz recommended that the Conservation Board accept the easement.

 

Mr. Schechter made a motion, seconded by Mr. Jaeger, to accept the conservation easement.

4.            Conservation Easement request – Jack King & Laurie Cushion, 6856 Scherff Road.  Requesting a perpetual conservation easement on 9.3 acres.

 

Mrs. Bergantz and Mr. Schichtel reviewed the property.  Mrs. Bergantz recommended that the Conservation Board accept the easement.

 

Mrs. Bergantz made a motion, seconded by Mr. Newton, to accept the conservation easement.

 

THE MOTION WAS UNANIMOUSLY APPROVED.

 

5.         Conservation Easement request – Boston Valley Pottery, Inc., Vacant land, east side of South Abbott Road.  Requesting a perpetual conservation easement on 42.8 acres.

 

Mrs. Bergantz and Mr. Schichtel reviewed the property.  Mrs. Bergantz recommended that the Conservation Board accept 41 acres for the easement, which would allow the petitioner to mine a quarry on the property in the future if he so chooses.

 

Mr. Ward made a motion, seconded by Mr. Schechter, to accept the conservation easement with the stipulation that only 41 acres be placed in  the easement so that in the future if the petitioner desires to mine the quarry in the front of the parcel he may do so.

 

THE MOTION WAS UNANIMOUSLY APPROVED.

 

6.            Conservation Easement request – Tony Hughes & Carole Owens, 5895 Cole Road.  Requesting a perpetual conservation easement on 6.37 acres.

 

Mrs. Bergantz agreed to review the property and report to the Board at its February meeting.

 

7.            Conservation Easement request – Raymond Williams, 6806 Cole Road.  Requesting a 15-year conservation easement on 13.37 acres.

 

Mrs. Bergantz agreed to review the property and report to the Board at its February meeting.

 

8.            Conservation Easement request – Frank & Rosetta Newton, 6463 Bunting Road.  Requesting to extend the current 10-year conservation easement to a period of 15 years.

 

Mrs. Bergantz agreed to review the property and report to the Board at its February meeting.
