Minutes of the March 31, 2009 meeting of the CONSERVATION BOARD of the TOWN OF ORCHARD PARK, Municipal Center, Basement Meeting Room 4295 South Buffalo Street, Orchard Park, New York at 7:00 PM. Present were the following:

The Chairman called the meeting to order at 7:00 P.M. by stating that in accordance with the provisions of the Ethics Law of the Town of Orchard Park it is incumbent upon any Conservation Board member with a financial or business relationship with any petitioner coming before this Board to disclose this relationship and, if warranted, to recuse him or herself from any matter involving the petitioner. Any petitioner coming before this Board who is a relative of, or has a financial or business relationship with, any officer or employee of the Town of Orchard Park, must disclose the nature and extent of such relationship in accordance with the provisions of the ethics law of the Town of Orchard Park.
APPROVAL OF MINUTES:
A MOTION was made by Ms. Bergantz, seconded by Mr. Schichtel, to ACCEPT the minutes of the February 3, 2009 meeting.
MOTION UNANIMOUSLY APPROVED.
The Chairman stated that the March 3, 2009 meeting minutes will be a voted on at a later date.
The Chairman welcomed the new Alternate member to the Board, Mr. Andrew Sako, who will be a voting member next month.
OLD BUSINESS
1. C.B. File #37-07 Ashley Furniture out-parcel and Ashley Furniture site, bordered by Amelia Drive on the west and Milestrip Road on the south, Zoned B-1. Board members to discuss planting maintenance agreement.
The Chairman noted that this case has been tabled until June per the request of the petitioner.
CONCEPT REVIEW
1. C.B. File #10-09 Southtowns Tennis Center, 75 Mid County Drive, located on the east side of Mid County Drive, Zoned I-1. Conservation Board to review proposed expansion.

Mr. Jack Ruh, Petitioner
Mr. Bammel presented aerial photos of the site and explained the proposed expansion to the Board members. He told the Board that he met with the Town Engineering Department to review and discuss the project. Mr. Bammel feels that it may be possible for the existing drainage swail, located at the rear of the property to address drainage needs for this site and the surrounding properties.
Mr. Newton questioned if the site will have a retention basin. Mr. Bammel told the Board that the original building was constructed in 1972; at that time the proposed expansion was planned with an underground pipe in place to handle future drainage; however, today’s requirements will need to be reviewed and addressed for the proposed project.
Mrs. Bergantz discussed the proposed parking spaces at the site and questioned if the site will meet the 10% interior green space requirement. She also discussed putting in island areas; however, she suggested planting trees around the building, noting that the trees will aid in diminishing the water at the site. She told the applicant that she feels the main challenge at this site is storm water management; she suggests using pavers.
Mr. Bammel told the Board that the project requires an Area Variance for lot coverage and they are scheduled to appear before the Zoning Board of Appeals on April 21, 2009.
The Board members concluded that they like the concept plan and feel this is a good project.
