The function of the Town of Orchard Park Zoning Board of Appeals is to approve or deny requests for variances from the Town Code.
The Zoning Board of Appeals meets on the 3rd Tuesday of each month in the Basement Public Meeting Room of the Town Hall. All meetings start promptly at 7:30 p.m.

In 1941, the five member Zoning Board of Appeals was established
by the Town of Orchard Park pursuant to New York State Law. The
members are appointed by the Town Board to five year terms, with
one members' term expiring annually. An alternate is appointed
with a three year term. The Zoning Board of Appeals hears and
deliberates on cases from citizens seeking relief from the Town
ordinances. Decisions of this Board are based on strict criteria
defined by the State and may be appealed by court action. This Board
may advise the Town Board regarding zoning and development issues as
they deem necessary. In addition the Zoning Board of Appeals has the
authority to approve the location of cell towers as per Town of Orchard
Park Code.

will hold a Public Hearing on Tuesday, the 19th of August, 2008 at 7:30 P.M. in the Municipal Center Basement
Public Meeting Room, S 4295 South Buffalo Street, in said Town, in the matter of the following appeals:
NEW BUSINESS
1. ZBA File #23-08, David Kazmierczak, 6415 Milestrip Road, Zoned R-2 (Part of Farm Lot 20, Township 10, Range 7; SBL#161.08-1-10). Requests an area variance to construct an addition with a 25-ft., 2-inch front setback. Minimum front setback for this R-2 lot is 40-feet, Section 144-9B, Schedule of Height, Lot, Yard, and Bulk Regulations.
2, ZBA File #24-08, Jeffrey Abate, 5825 Scherff Road, Zoned A-1 (Part of Farm Lot 13, Township 9, Range 7; SBL#185.03-3-28.2). Requests an area variance to construct a garage addition with a 7-foot side setback. Minimum side setback for this A-1 lot is 30-feet, Section 144-9B, Schedule of Height, Lot, Yard and Bulk Regulations.
3. ZBA File #25-08, Michael Brennan, 2 Cherokee Drive, Zoned R-3 (Sub Lot 1, Map Cover 2936, SBL#153.09-4-1). Requests an area variance to install an 8-foot high fence within a side street yard. Maximum height of a fence in a side street yard is 3-feet, Section 144-22 A(1).
4. ZBA File #26-08, Kevin Schmidle, 7200 Ellicott Road, Zoned R-1 (Part of Farm Lot 60, Township 9, Range 7; SBL#185.00-3-30). Requests an area variance to construct a garage/pole barn with a 10-foot side setback. Minimum side setback for this R-1 lot is 15-feet, Section 144-9B, Schedule of Height, Lot, Yard, and Bulk Regulations.
