Governor Andrew M. Cuomo signed legislation (S.854-A/A.1248-A) legalizing adult-use cannabis for NYS. In 2018 the New York State Department of Health recommended that marijuana be legalized for recreational use in New York State.

The legislation created a two-tier licensing structure that will allow for dispensaries and/or on-site consumption licenses.

New York’s new law legalizing marijuana gives Orchard Park the option to opt-in or out of allowing marijuana-related businesses in our town. We have to make a decision by the end of 2021.

We need your input to come to some kind of conclusion, whether we want to have cannabis retail dispensaries or on-site consumption licenses.  As you may know, if we decide to prohibit retail dispensaries, we will not get a cut of the county sales tax.

We would like to reminded residents that while the town can limit marijuana-related businesses, it cannot prohibit the possession or use of marijuana.  Generally, marijuana may be consumed anywhere and may be smoked anywhere that smoking of tobacco is not prohibited.
